Program: SOMBA® Kickstart (“Program”)
Provider: Sigrun GmbH, Suurstoffi 37, 6343 Rotkreuz, Switzerland (“Sigrun”, “we”, “us”, “our”)

 

1. Relationship to General Terms

This Program-Specific Terms & Conditions Addendum (“Addendum”) supplements and forms part of our General Terms & Conditions available at www.sigrun.com/terms-conditions (“General Terms”). By purchasing or accessing the Program, you agree to be bound by the General Terms and this Addendum. In the event of any conflict, this Addendum prevails with respect to the Program.

 

2. Program Overview

SOMBA® Kickstart is a 12-week educational and training program designed to support its students in creating a free 4-week online course, growing their email list, and to making a paid offer. The Program may include training modules, technical tutorials, live and/or recorded coaching calls, community access, and proprietary materials, delivered via our platforms or selected third-party tools.

 

3. Access Periods

Your access to the Program is limited as follows:

  • Access to live coaching and the private community is provided for 12 weeks from January 12, 2026 through April 3, 2026. After April 3, 2026, all coaching and community access ends.
  • Access to the teaching platform, including all training modules and technical tutorials, is granted for 12 months from the date of purchase, after which access ends automatically.

All access periods are contractual limits and not guarantees of continued availability.

 

4. Intellectual Property

All Program content, including but not limited to the Program name, curriculum, structure, sequencing, methodologies, templates, recordings, and materials, is the exclusive intellectual property of Sigrun and is protected by copyright, trademark, and unfair competition laws. Participation in the Program does not transfer any ownership or intellectual property rights.

 

5. License, Individual Access, and Acceptable Use

You are granted a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Program materials solely for your own learning and implementation in your own online business.

Program access is granted to one individual only. You may not share login credentials, allow third-party access, or access the Program on behalf of another person.

You may not copy, reproduce, distribute, disclose, or otherwise make available any Program materials to third parties, except where expressly permitted in writing by Sigrun. This license terminates automatically upon expiration of access or breach of these terms.

 

6. Prohibited Use and Non-Replication

You agree that you will not, directly or indirectly:

  • create, offer, or deliver any free or paid program, training, or service that is identical to, substantially similar to, or derived from SOMBA® Kickstart;
  • replicate the Program’s structure, curriculum, sequencing, pacing, or educational design;
  • present the Program or any adapted version as your own original work;
  • assist or enable any third party in doing any of the above.

This restriction applies to both free and paid offers.

You may apply what you learn in your own online business.
You may not teach, commercialize, license, or repurpose how the Program itself is taught.

 

7. Public vs. Protected Content

Certain aspects of the SOMBA® Kickstart methodology have been publicly disclosed by Sigrun, including through books (including Kickstart Your Online Business), podcasts, and marketing materials (“Public Materials”).

Nothing in this Addendum restricts your right to reference or discuss Public Materials. However, the Program’s specific implementation, structure, delivery, content, and materials remain protected intellectual property.

The fact that elements of the Program are publicly described does not grant any license or right to reproduce, commercialize, or teach the Program or a substantially similar version thereof.

 

8. Confidentiality

You agree not to disclose or share any non-public Program materials or recordings with third parties, except where expressly permitted in writing by Sigrun. These confidentiality obligations survive the end of your access.

 

9. Community, Calls, and Conduct

The Program includes live calls and access to a private online community as part of the paid Program.

By participating in the Program, you agree to comply with the following community and conduct rules, which are designed to protect a safe, focused, and supportive learning environment.

a) No Promotion or Solicitation

You agree that you will not, directly or indirectly:

  • promote, market, pitch, or sell any product, service, program, event, or offer;
  • post links to your own or third-party websites, groups, content, surveys, or affiliate offers;
  • post content intended to generate leads, clients, visibility, or business opportunities;
  • request that other participants contact you privately (e.g. asking others to DM or message you);
  • use the community or live calls for market research or solicitation purposes.

Any promotion is permitted only where expressly designated or approved by Sigrun in writing.

b) No Private Messaging Without Permission

You may not send private messages to other participants, Sigrun, or the Program team in connection with the Program unless prior permission has been given in the context of the Program (for example, through an explicit invitation to message).

c) Content and Participation Rules

You agree that you will not:

  • post videos, livestream, or otherwise broadcast yourself in the community unless expressly permitted;
  • post offensive, abusive, discriminatory, misleading, or disruptive content;
  • create subgroups, side communities, or parallel groups using Program participants without prior written permission from Sigrun;
  • misuse Sigrun®, SOMBA®, or any related trademarks

d) Independent Responsibility and No Endorsement

Any opinions, advice, or information shared by other participants are their own. You acknowledge that:

  • interactions with other participants are at your own risk,
  • Sigrun does not endorse, vet, or guarantee participants or their services,
  • you are responsible for conducting your own due diligence before entering into any business or personal relationship with another participant.

e) Moderation, Removal, and Enforcement

We reserve the right, at our sole discretion and without prior notice, to:

  • remove posts or content,
  • mute or remove participants from live calls,
  • remove participants from the community,
  • terminate Program access entirely,

if we reasonably believe these rules or the Addendum have been violated.

Removal from the community or calls does not entitle you to a refund, compensation, or extension of access.

f) Platform Changes

Community access may be moved, modified, or discontinued if required due to platform changes, policy updates, or operational needs.

 

10. AI Tools and Automated Assistance

As part of the Program, we may provide access to AI-powered tools, software, or features developed or made available by Sigrun (the “AI Tools”).

The AI Tools are provided for educational and assistive purposes only. They are designed to support learning, ideation, and implementation but do not replace human judgment.

You acknowledge and agree that:

  • AI-generated outputs may be incomplete, inaccurate, outdated, or inappropriate;
  • AI Tools may generate errors, omissions, or misleading information;
  • AI Tools do not constitute financial, legal, business, tax, or professional advice.

You remain solely responsible for:

  • verifying any AI-generated information before relying on it,
  • your decisions, actions, and results arising from use of the AI Tools.

We make no representations or warranties regarding the accuracy, reliability, completeness, or suitability of any AI-generated output.

To the maximum extent permitted by law, Sigrun disclaims all liability for any loss, damage, or consequences arising from your use of or reliance on the AI Tools. 

We do not guarantee the availability, uninterrupted operation, or continued functionality of any AI Tools.

 

11. No Refunds

SOMBA® Kickstart is a digital program that provides immediate access to proprietary digital content and services. All purchases are final. We operate a strict no-refund policy.

To the maximum extent permitted by applicable law, you expressly acknowledge and agree that:

  • you waive any statutory right of withdrawal, including any right of withdrawal under EU consumer protection laws,
  • you are not entitled to cancel, revoke, or withdraw from this purchase once access to the Program has been granted.

 

No refunds, partial refunds, or chargebacks will be issued under any circumstances.

 

12. Success-Based Guarantee

We offer a success-based, non-monetary guarantee.

If, after completing the 12-week SOMBA® Kickstart Program, you have:

  • not created an online course, and
  • not built an email list,

you may be eligible to receive complimentary access to a follow-on program selected by Sigrun, with additional guidance and support for a further 12 weeks at no additional cost.

This guarantee does not create any right to a refund or monetary compensation.

Eligibility for the success-based guarantee requires:

  • active participation during the Program period,
  • completion of the core training modules,
  • a genuine and reasonable implementation effort,
  • filled out all five progress forms,
  • submission of a written request to info@sigrun.com before April 7, 2026

 

The success-based guarantee described in this section is your sole and exclusive remedy in connection with dissatisfaction with the Program.

 

13. Earnings and Results Disclaimer

SOMBA® Kickstart is an educational and training program.

Any references to income, revenue, sales figures, or financial results in connection with the Program—including in marketing materials, testimonials, case studies, examples, or participant stories—are illustrative only and represent individual experiences.

We do not promise, guarantee, or imply any specific financial outcome, income level, revenue amount, or business success as a result of participating in the Program.

Your results depend on many factors beyond our control, including but not limited to your background, experience, skills, effort, implementation, market conditions, and external circumstances.

By purchasing and participating in the Program, you acknowledge that:

  • no monetary or financial outcomes are guaranteed,
  • you are solely responsible for your decisions, actions, and results,
  • participation in the Program does not constitute financial, legal, or business advice.


14. Termination and Enforcement

We may suspend or terminate access to the Program, without refund, if we reasonably believe you have violated this Addendum or the General Terms.

You acknowledge that misuse of our intellectual property may cause irreparable harm, entitling us to seek injunctive relief, in addition to other remedies available under Swiss law.

 

15. Contractual Penalty and Damages

If you breach Sections 4–8 of this Addendum, including intellectual property, confidentiality, or non-replication obligations, you agree to pay a contractual penalty of CHF 3,000 per breach.

Payment of this penalty does not limit our right to seek injunctive relief, claim additional damages, or recover legal costs to the extent permitted by law.

 

16. Governing Law and Jurisdiction

This Addendum is governed by Swiss law.


The jurisdiction provisions of the General Terms apply.
